The Public Sector in the Free Electricity Market: Conditions for Legal Viability

The Brazilian Electric Sector (SEB) has been facing significant changes since the 1990s, with the privatization of the sector and the approval of new regulations. The laws enacted in the period brought a new institutional design for the energy generation, transmission and distribution segments, and enabled not only the regulation of energy contracts - in the figure of the captive consumer - but also supported the emergence of the free consumer, without the contractual rigidity that characterizes a typically regulated environment. This work intends at analyzing the legal feasibility of public bodies to migrate to the Free Energy Market, negotiating their own supply contracts in this environment for offices, sports arenas and cultural centers, among others - instead of keep those as captive consumers.
